The key of success for environmental legislation and green justice

Environmental Justice is not only concern of every human being  but of every living being on planet earth . To protect the right of future generations, environmental jurisprudence is evolved by international agencies, environment scientist and the judiciary of the world. The so called green laws, acquired significant importance in the IT world. A global transition to a low carbon and sustainable economy has already created large number of green jobs across diverse sectors of the economy and has indeed become an engine of development.

As sustainability becomes a global priority, lawyers who can advise client on green standards and sustainability issues are in demand. It is predicted that climate change, global warming, clean environment will increase the legal work for environmental lawyers in coming years. The love for protection, preservation and promotion of clean environment resulted into enactment of multiple legislations across the globe. Soon it was realised that the environmental justice will be a paper justice if it is limited to the law books, courts, judges and lawyers. Need was felt to sensitise every human being concerned to contribute for Green Justice by sensitising him on environment issues through basics of Environmental Education.

Taking a leaf further the Supreme Court of India in a Public Interest Litigation filed by Sr. Advocate M.C. Mehta propounded mandatory green education at school and undergraduate programs in colleges.  The intention was to create environmental activist in every human being to sustain and strengthen Environmental Justice.  The concept of Polluters Pay and Sustainable development became the heart and soul for Environmental Litigations.

The Bar Council of India realising the necessity of Environmental Lawyers issued mandate to make compulsory law paper in the legal education curriculum on Environmental Law and Protection of Wildlife. It covers, Environmental Policy , measures for Environment protection , functioning of Environmental Tribunal, preventive measures for pollution, global warming and climate change etc.
2010 was a landmark year , wherein in India, Green Revolution took place in the form of establishment of National Green Tribunal which aimed at ensuring Environmental Justice to the poorest of the poor. Landmark Judgements of National Green Tribunal on various important environmental issues made India proud and nurtured the dream of Swacha Bharat and Swarna Bharat.
The key of success for environmental legislation and green justice lies in awareness of Environmental related human rights and imparting of Green Education. At present in India, beside compulsory Environmental Studies paper following opportunities are available to excel in environmental Lawyering:

1. LLM in Environmental Law Degree Program polishes and trains lawyer / law student in International related Environmental issues , comparative research and generates Environmental Journalist/ Judges.

2. Postgraduate Diploma in Environmental Law And Policy is a one year program providing opportunity to the students to understand issues, institutions and initiatives in the field of Environmental Law And Policy with practical training.

3. M. C. Mehta Environmental Foundation’s work on sustainable development and Environmental education is laudable.

4. Bharati Vidyapeeth Deemed to be University Pune Institute of Environment Education and Research Pune was pioneer in drafting the syllabus and writing the official textbook for Environmental Studies paper which is now published in 5 Indian languages. Courses offered by the institution include Bachelor and Masters in Environmental Science.

The modern environmental education shall encompass specialisation in Bio Diversity Conservation, measures of Green Audit management to control pollution, use of green technology, eco system and energy management etc.  The Environmental Jurisprudence in India is the brain child of the Supreme Court in M. C. Mehta’s multiple PIL cases. India is blessed with good environment and nicest climate, with the urgent need having nicest people to carry it as gift to the future Indians.
